The judge, Colonel James Pohl, made the ruling during a pre-trial hearing today in Baghdad for three soldiers charged in the Iraqi prisoner abuse scandal.
The three -- Sergeant Javal Davis, Staff Sergeant Ivan Frederick, and Corporal Charles Graner -- face a number of charges. They are among seven junior ranking U.S. servicemen charged over the abuse and will face courts martial at a later date.
The only soldier brought so far to trial over the abuse -- Jeremy Sivits -- was sentenced last month to a year in prison after pleading guilty for his role in the abuse of Iraqi prisoners at Abu Ghrayb prison near Baghdad.
